Despite the most complete and well-drafted of trust deeds, there are issues and situations encountered by trustees in the administration of trusts which are beyond the terms of the trust deed. These range from beneficiaries objecting to the trustee’s exercise of its discretion, decisions whether to redevelop or simply repair a trust asset, to threatened litigation whether from the beneficiaries or third parties.

 

The Webinar discusses the options available to a trustee, the extent to which the trustee can seek assistance from the courts and the means and tools by which the trustee has to protect itself.
