In International Arbitration, dealing with damages is often a tricky and complex process. Various drivers such as differences in approach across jurisdictions and the roles played by counsels and experts sometimes influence the outcome in unexpected ways.

 

Our International Arbitration Partner Smitha Menon authored an article titled ‘Inadequate Handling of Damages in International Arbitration’, which takes a closer look at these drivers and how they affect quantification of damages in arbitrations.

 

The article is part of the Vol 17 No 1 May 2023 issue of the Dispute Resolution International, the journal of the IBA's Dispute Resolution Section.
