(Head of International Arbitration) together with Tiong Teck Wee (Partner) and Thea Elyssa Vega (Foreign Lawyer), have contributed a chapter titled “Review of Case Law: Admissibility and Jurisdiction for Multi-Tiered Dispute Resolution Clauses” to An Arbitration Companion: Liber Amicorum for Michael Lee.

The liber amicorum is a compendium of contributions by notable international arbitration practitioners on contemporary issues in international arbitration, paying tribute to Michael Lee, a leading international commercial arbitrator.

Multi-tiered dispute resolution clauses are increasingly common in commercial contracts, often giving rise to questions as to whether compliance with pre-arbitration requirements is a pre-condition for arbitration, and whether failure to comply with these requirements raises issues of admissibility or goes to the jurisdiction of the tribunal. In the chapter, our team examines recent developments and judicial approaches to these issues across various jurisdictions.
