Our Deputy Managing Partner and Head of the Firm’s Litigation & Dispute Resolution Group, Chou Sean Yu, together with our Head of International Arbitration Koh Swee Yen SC, and Partners Lim Wei Lee and Alessa Pang, recently contributed an article titled “Perceptions of Impartiality: Apparent Bias in Arbitration” to The Legal 500 International Arbitration Comparative Guide 2025 (9th Edition).

The article explores key issues and recent trends relating to an arbitrator’s fundamental duty to be impartial and independent, by examining recent case law on apparent bias in England and Singapore. The article also considers the way forward, looking to “soft law” instruments such as the IBA Guidelines on Conflict of Interest, as well as suggested best practices which parties and counsel may wish to adopt. As arbitration continues to be the preferred method for resolving cross-border disputes, ensuring confidence in the legitimacy of the process remains critical.
